Rose McGowan Casts Blame For Felony Drug Arrest But Is She Right?

The Loudoun County Sheriff’s Office (VA) arrested Rose McGowan today. Officials charged McGowan with felony drug possession. The police took her mug shots and fingerprints. A magistrate released her on $5,000 bail.

The charges stem from a flight McGowan took in January. The cabin cleaners found McGowan’s wallet after she left it on the plane at Dulles International Airport. They turned the wallet into airport authorities. Police, then, found two small baggies of cocaine inside the wallet. To nobody’s surprise, an investigation began.

Cocaine possession is a Class 5 felony in Virginia

Dulles International Airport is one of three airports in the D.C. area. It sits in Virginia. Ergo, Virginia laws apply. Those charged with possession of a controlled substance in Virginia are looking at a Class 5 felony.

The Commonwealth recognizes six classes of felonies. Class one felonies are the worst of the worst. Think capital murder and first-degree murder. Defendants found guilty of class one felonies may receive a sentence of life in prison or death.

Class five and six felonies are less severe felonies. Virginians call them “wobbler” crimes. And, wobbler crimes are unusual.

They are unusual because the Commonwealth can prosecute wobblers as felonies or misdemeanors. Prosecutors may offer plea agreements that reduce the charge to a misdemeanor in exchange for a guilty plea.

Maybe you don’t care much about the difference between felonies and misdemeanors. But hear this: the Commonwealth will not expunge a felony conviction! It will expunge a misdemeanor.

Also, Rose McGowan may completely avoid jail time if the prosecutor reduces her crime to a misdemeanor

Ignore rumors about the reason for McGowan’s arrest

Rose McGowan hit Twitter after she found out about the warrant. (I mean, what else is a girl to do?!) She called the charge “horse$#!t” suggesting that charges were brought because she spoke out against Harvey Weinstein.

Excuse me, what?!

First, girlfriend brought cocaine on an airplane. Next, she forgot her cocaine on the airplane. Finally, she forgot her cocaine on the plane nestled up next to her ID!

Rose McGowan got caught.

The airport police issued a warrant for her arrest in February. Additionally, they put the warrant into a national database when they couldn’t get ahold of her. To suggest that Harvey Weinstein somehow has two police departments in his back pocket is crazy.

McGowan broke the law, plain and simple. Poor people and minorities are charged and convicted under this statute every single day. The law shouldn’t treat famous, rich, white women any differently.
